Update: Supreme Court to Hear Indefinite Detention Case, Al-Marri v. Pucciarelli

A small band of lawyers remain diligently at work fighting for a Supreme Court win in Al-Marri v. Pucciarelli that would answer a huge question for our democracy: Whether we are a tyranny or a country where the rule of law, due process, and habeas corpus reign supreme.

Typical of today's Republican Party, the GOP has come down on the anti-liberty side of the argument.

From the Brennan Center:

Question Presented – Does the Executive have legal authority to detain a legal resident arrested in the United States without charge by declaring him an 'enemy combatant'? This case challenges the President’s assertion of unchecked executive detention power over all individuals in the United States.

Update: Voting-rights activists cut a deal with Colorado's secretary of state late Wednesday that will ensure some 20,000 voters removed from state rolls will get to cast a ballot.

Colorado is in play with a slight and growing Obama lead, and together with a Virginia win for Obama would all but guarantee a victory for the Democratic nominee.

The GOP is trying suppress voters en masse, courtesy of Colorado's Katherine Harris: Secretary of State Mike Coffman.

Fortunately, the judge hearing the case is Judge John L. Kane, a rule-of-law judge with an honest reputation.

From the Brennan Center for Justice's Susan Lehman:

Colorado may have illegally purged 27,000 voters from the state's voter registration lists.

The Brennan Center for Justice is compiling a comprehensive synopsis of current voter suppression incidents around the country of which McCain co-chair and Wisconsin Attorney General J.B. Van Hollen' dismissed suit comprises just one of many.
The Voter Suppression Incidents 2008 is an excellent resource, please check it out.
And spread the word: The nonpartisan Election protection coalition (http://www.866ourvote.org/) is fighting voter suppression and is a great resource. Look them up with any problems or concerns: Call 1 866 OUR VOTE (1 866 687 8683).

Forget ACORN (and here's a good article about how they've actually followed the law), here's the real case of voter fraud that no one wants you to notice - since 2004, as many as 13 million voters have been purged from the roles. This is the concerted effort being perpetrated on American citizens by elected officials like Wisconsin Attorney General J. B. Van Hollen, and those in 39 other states.

They're using clerical errors to suppress voter turnout, folks. This isn't a matter of "cleansing voter roles" for inaccurate information. This is a war on democracy. And it's being done today, illegally, within 90 days of the election.

13 million voters purged. Think about that. And naturally, it's heavily occurring in battle ground states.

The Brennan Center for Justice has the details in its latest report.

And, shock, even mainstream media outlets are beginning to take notice. Here's the latest from CBS.

Face it Republicans, you are going to lose and you are going to lose big.

But not without a lot of whining and lying first.

Brad Friedman eviscerates the GOP voter fraud lie aimed at the group ACORN, the Association for Community Organisations for Reform Now.

The crimes of ACORN are as Friedman writes in The Guardian:

... that Acorn managed to register some 1.3 (million) low-income (read: Democratic-leaning) voters over the past two years. The rest is, pretty much, just made up. ... Despite the screaming wall-to-wall coverage of 'Democratic voter fraud in 11 swing states' as seen on Fox News and even the once-respectable CNN, none of it's true.

Seven civil rights and public interests groups submitted their amici curiae brief in support of the Wisconsin General Accountability Board's (GAB) motion to dismiss the Attorney General's legal petition endorsed by the Wisconsin Republican Party.

Voters' rights communities fear that the Wisconsin Attorney General would suppress voters in the presidential election, characterize the move as a continuation of the national GOP voter suppression effort, and see a corrupt use of the Attorney General's office for partisan gain.

The Brennan Center for Justice has just released its comprehensive report on massive voter purging, the practice of striking voters from voter rolls.

Wisconsin is fortunate in that the General Accountability Board has steadfastly refused to prematurely strike voters from its voting rolls, despite the GOP and Attorney General and McCain co-chair J.B. Van Hollen's efforts. In fact, the "Board also decided not to adopt a rule flagging voters on the poll list ...," much less striking a name from the voting rolls.

The highly respected Brennan Center for Justice at New York University's School of Law, has a comprehensive, well researched and documented white paper by Justin Levitt on recent allegations of voter fraud allegedly occurring in Wisconsin and other states within the last eight years, entitled, "The Truth About Voter Fraud."

Once you read it, your eyes will be opened to the sham that is being perpetrated upon the U.S. voters. In fact, one could easily argue that the widespread rumors of voter fraud exist to confuse the populace and further deepen the cynicism of our electoral process. These efforts may also serve a larger agenda to keep real voting reform off the table, that is, extending the time people are allowed to cast votes; make it LESS burdensome for people to vote in the first place; and acts by political campaigns to buy votes, among many others.

Public financing, education, and aggressive journalism point the way out of the unholy mess the election of Wisconsin Supreme Court justices has become.

So bad is Wisconsin that we are now a poster child for a nationwide problem with electing judges.

Another part of the solution proposed is more aggressive recusal rules, negating the rationale behind buying a Supreme Court seat.
